These Terms of Service (“Terms”) govern your access to and use of the services provided by Proton Technologies Limited (“Proton,” “we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
01Acceptance of terms
These Terms apply to our website, hosted products, custom software engagements, automation work, and related support. Where a signed proposal, statement of work, or order form adds specific commercial terms, those documents control for that engagement to the extent of any conflict with these general Terms.
02Services
We provide customized software and automation solutions, including but not limited to:
- Professional websites with hosting and ongoing care options
- Quoting tools, internal process applications, and operational dashboards
- Integrations and automation tailored to business workflows
- Related consulting, configuration, and support as scoped in writing
Features, timelines, and deliverables for a given project are defined in the applicable proposal or statement of work—not by marketing copy alone.
03User responsibilities
You agree to:
- Use our services for lawful purposes only and in accordance with these Terms.
- Provide accurate information needed to deliver and support your engagement.
- Maintain the confidentiality of login credentials and promptly notify us of suspected unauthorized access.
- Be responsible for activity that occurs under your accounts and for content you supply.
04Accounts & access
Some services require accounts or access credentials. You must keep credentials secure and limit sharing to authorized users in your organization. We may suspend access that appears compromised or that violates these Terms, and will work with you to restore legitimate access when appropriate.
05Payment structure
Unless a written agreement states otherwise, custom projects follow this billing structure:
- An initial setup fee is payable before work begins.
- After project completion and delivery, a recurring monthly subscription maintains access to the service and ongoing care as scoped.
- Monthly subscriptions are billed in advance and continue automatically until canceled.
Setup fee refunds
The initial setup fee is fully refundable if you are not satisfied with our product after finishing and before the monthly subscription begins. Contact us to request a full refund in that window.
The setup fee cannot be refunded after the monthly subscription begins.
To cancel your subscription, email sales@protontechnologies.limited at least 7 days before your next billing date. No refunds are issued for partial months of service.
06Intellectual property
All content, software, designs, documentation, and related materials we create or provide are the property of Proton Technology Limited unless explicitly stated otherwise in a written agreement. You may not copy, reproduce, reverse engineer, or distribute our materials without prior written consent.
You retain ownership of materials you supply to us (such as logos, copy, and data). You grant us a limited license to use those materials solely to deliver and operate the services you requested.
07Marketing & promotion
By using our services, you grant Proton Technologies Limited the right to display your business name and logo on our website (protontechnologies.limited) and in our marketing materials for promotional purposes. If you wish to opt out, notify us in writing at support@protontechnologies.limited.
08Availability & support
We aim for reliable hosting and responsive support consistent with your plan. Scheduled maintenance, third-party outages, or events beyond our reasonable control may affect availability. Plan entitlements (response times, revision allowances, and hosting tier) are described on our pricing pages and in your agreement.
09Termination
We reserve the right to suspend or terminate your access to our services if you violate these Terms or engage in unlawful or harmful activity. You may stop using the services and cancel subscriptions as described in the payment section. Provisions that by nature should survive (including intellectual property, payment obligations already incurred, and limitation of liability) continue after termination.
10Limitation of liability
To the fullest extent permitted by law, Proton Technologies Limited is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from your use of the services. Our aggregate liability arising out of these Terms or the services is limited to the amounts you paid us for the services giving rise to the claim in the twelve (12) months before the claim arose, except where liability cannot be limited by law.
11Changes to terms
We may update these Terms from time to time. The latest version will always be available on this page with an updated date. Continued use of our services after changes take effect constitutes acceptance of the updated Terms. Material commercial changes to an active paid engagement will be communicated as appropriate.
